Terms of service

These Terms of Service ("Terms") set out the conditions for using FILTH (https://filthhomme.com/, the "Store"), an online store operated by Vapors Co., Ltd. ("we" or "us"). By using the Store, you ("Customer") agree to these Terms.

Article 1 (Scope)
1. These Terms apply to all matters relating to your use of the Store between you and us.
2. The Legal Notice, Shipping Policy, Refund Policy, Privacy Policy, and other rules posted on the Store ("Individual Rules") form part of these Terms. If these Terms conflict with the Individual Rules, the Individual Rules prevail.

Article 2 (Account Registration)
1. You may register an account in the manner we specify. You can also purchase products without an account.
2. We may decline a registration if it contains false information, if the applicant has previously violated these Terms, or if we otherwise consider it inappropriate.

Article 3 (Account Security)
1. You are responsible for keeping your login information secure and must not allow any third party to use it.
2. Any use made with your registered login information is deemed to be your own use, unless we are at fault, intentionally or negligently.

Article 4 (Formation of Sales Contract)
1. A sales contract is formed when you complete your order through the Store and we send you an order confirmation email.
2. If a product is out of stock, a price is displayed incorrectly, or there are other unavoidable circumstances, we may cancel your order after contacting you, even after the contract has been formed. In that case, we will refund any amount you have paid.

Article 5 (Prices and Payment)
1. Product prices are as shown on each product page (tax included for prices in Japanese yen).
2. Shipping and other additional charges are set out in the Legal Notice and the Shipping Policy.
3. Payment methods are as set out in the Legal Notice.

Article 6 (Shipping)
Shipping methods, delivery times, and shipping fees are set out in the Shipping Policy and the Legal Notice.

Article 7 (Returns and Exchanges)
Returns and exchanges are accepted only in the cases set out in the Refund Policy.

Article 8 (Cancellations)
As a rule, we do not accept cancellations or changes for customer reasons once an order has been confirmed.

Article 9 (Intellectual Property)
All copyrights, trademarks, and other intellectual property rights in the text, images, logos, and other content on the Store belong to us or their rightful owners. You may not copy, reproduce, or modify them beyond personal use.

Article 10 (Prohibited Acts)
When using the Store, you must not:
・Violate laws or public order and morals
・Purchase products for the purpose of resale
・Register false information or impersonate another person
・Place an excessive load on the Store's servers or network, or gain or attempt to gain unauthorized access
・Infringe the intellectual property rights, privacy, or other rights of us or any third party
・Interfere with the operation of the Store
・Provide any benefit, directly or indirectly, to antisocial forces
・Engage in any other act we consider inappropriate

Article 11 (Restriction of Use and Account Deletion)
If you violate these Terms, we may cancel your orders, restrict your use of the Store, or delete your account without prior notice.

Article 12 (Suspension or Changes to the Store)
We may suspend or change all or part of the Store for system maintenance, natural disasters, network failures, or other unavoidable reasons.

Article 13 (Limitation of Liability)
1. We are not liable for any damage you incur through your use of the Store, except where caused by our intentional misconduct or gross negligence.
2. If you incur damage due to our negligence (excluding gross negligence), our liability is limited to the price of the order that caused the damage.
3. The preceding two paragraphs do not apply where exemption or limitation of our liability is not permitted under the Consumer Contract Act or other laws.

Article 14 (Personal Information)
We handle your personal information in accordance with our Privacy Policy.

Article 15 (Changes to These Terms)
We may change these Terms in accordance with Article 548-4 of the Civil Code of Japan. When we do, we will announce the revised Terms and their effective date on the Store a reasonable period before they take effect.

Article 16 (Governing Law and Jurisdiction)
1. These Terms are governed by the laws of Japan.
2. The Tokyo District Court has exclusive jurisdiction as the court of first instance over any dispute relating to the Store.
